Terms of Service – Ek Din (Cultural Rental)

These Terms of Service (“Terms”) are between you (“you” or “your”) and Ek Din Pty Ltd (“we,” “our,” “us,” or “Ek Din”), and govern your access to and use of our website at [www.ekdin.com.au]. By accessing or using our site, you accept and consent to the practices in these Terms, including this Terms of Service and any linked policies such as Privacy or Copyright policies.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms, you may not access the website or use any services.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed and construed in accordance with the laws of Australia.

These Terms apply to all users of the site, including users who are browsers, vendors, customers, merchants, or contributors of content. Ek Din reserves the right to change these Terms and policies at any time at its sole discretion. It is your responsibility to check this page periodically for updates.

• Our website is intended for users who are 15+. By agreeing to these Terms, you represent that you meet the minimum age requirement in your jurisdiction.
• You may not use our products or services for any illegal or unauthorised purpose.
• You must not transmit any viruses or destructive code. Violation of these Terms may result in immediate termination of Services.
• We reserve the right to refuse service to anyone at any time.
• Prices for products or rentals are subject to change without notice.

• You agree to treat rented or purchased items with care. The rental coverage provided covers normal wear and tear, but you are responsible for any loss, damage, or destruction of products.
• “Normal wear and tear” means minor stains, loose threads, missing beads, stuck zippers, etc.
• If a product is returned damaged beyond normal wear and tear, Ek Din will withhold your bond and may charge your Payment Method for repair or replacement, up to the Original Retail or Comparable Value price.

• You are responsible for providing accurate shipping information.
• Upon delivery, you are responsible for the condition of the item until it is returned.
• You agree to return each rented item by the agreed upon date, specified in your order.
• Late returns will incur a late fee of (subject to each vendor) of the product’s rental price per day.
• Failure to return an item will result in being charged the replacement cost.

• Cancellations must be made one month before the rental start date.
• Cancellations within the month of initial rental date will be non-refundable.
• Exceptional circumstances (serious illness, natural disaster, etc.) may be eligible for a full refund.

• Items must be provided to customers in good, wearable condition. Minor damage such as stains or loose threads is acceptable.
• Customers accept liability for damage during possession of the product.
• Ek Din will inspect items upon return and may charge for repairs or replacement if damage exceeds normal wear and tear.

• Ek Din may use third-party couriers for delivery. Couriers are independent and not responsible for our service.
• You are responsible for ensuring items are received securely at the delivery address provided.

• By using Ek Din services, you consent to receiving emails or messages about orders, reminders, and transactional information.
• You may opt out of promotional communications at any time, but important transactional messages may still be sent.

• Ek Din is not liable for any loss or damage resulting from use or inability to use the service, or from use of rented products.
• Products are provided “as is” without warranty.

You agree to indemnify and hold Ek Din harmless from claims arising from your breach of these Terms or violation of any law.
